Personal Information
While processing your order, TIM may collect personally identifiable information about you as well as about your friends and family in Haiti for whom you are purchasing services and products ("End Users"). Such personally identifiable information may include without limitation: your credit card number, your e-mail address, your address and telephone number, as well as the names, addresses, e-mail addresses, telephone numbers, and Haitian Identity Numbers of your End Users ("Personal Information").
Anonymous Information
Through your use of the Site, TIM may also gather certain information that does not identify you individually ("Anonymous Information"). Anonymous Information is conducted through “traffic data” and entails the use of cookies, described more particularly below.
Use of Cookies
Like many Web sites, TIM’s Site uses “cookies,” which are files that your browser stores on your computer hard drive. Cookies help TIM identify users and optimize their shopping experience. For example, cookies allow TIM to hold selections in your shopping cart when you leave the Site before checkout. Most browsers accept cookies automatically but allow you to disable them. TIM may also use your Personal Information to respond to your inquiries or provide feedback regarding the Site.
With regard to the services and products available through the Site, TIM is acting solely as the agent of Communication Cellulaire d’Haiti S.A. ("Comcel"), the provider of Voilà wireless services and products in Haiti. Accordingly, when you submit Personal Information to TIM through the Site, you understand and agree that such Personal Information may be transferred across national borders and may be stored and processed by Comcel in Haiti or in any of the other countries in which Comcel and/or TIM maintain offices. While such Personal Information is in Comcel’s possession, it will be governed by the terms of this Policy.
Third-Party Agents
TIM may occasionally have third-party agents perform functions on its behalf such as marketing, analytics, credit-card processing, provision of customer services, and programming TIM’s Site. These agents may have access to your Personal Information as strictly needed to perform their functions, and will be contractually obligated to maintain the confidentiality and security of Personal Information.
Emergency Situations
TIM may also disclose Personal Information if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to applicable law or comply with legal process served on TIM, Comcel, or the Site; (b) protect and defend the rights of TIM, Comcel, or the Site; and (c) under emergency circumstances, to protect the personal safety of TIM or Comcel staff, Site users, or the public.
Corporate Reorganization
TIM may disclose Personal Information as part of a corporate business transaction, such as merger, acquisition, corporate reorganization, financing, or sale of company assets. TIM may also disclose Personal Information in the event of an insolvency, a bankruptcy, or a receivership in which such information may be transferred to third parties as one of the business assets in the transaction.
Retention of Personal Information
TIM retains Personal Information for as long as TIM has a business need for it and as applicable laws and regulations require TIM to retain it.
Use of Anonymous Information
TIM uses Anonymous Information to help TIM determine how people use the Site so TIM can improve its Site and ensure that it is as appealing as TIM can make it for as many people as possible. TIM also uses Anonymous Information to provide statistical information in aggregated form to TIM affiliates, partners, and others about how TIM’s users collectively use the Site. The practices described in this Policy do not apply to information gathered through other Web sites including, information gathered by Comcel. Such other Web sites may send their own cookies to you, collect your data, or solicit your personal information. TIM is not responsible for the actions and privacy policies of such other Web sites. Information, text, images, or other content that you share on public areas becomes public. This Policy, therefore, does not apply to it. Be careful about the information you disclose in pubic areas and post no Personal Information that you expect to keep private.
The Site is published in the United States, and U.S. law will govern in any and all disputes, including privacy or defamation disputes or otherwise. Any claim made by you against TIM or any of its affiliates, directors, officers, employees, and agents arising out of these Policies or your use of this Site will be resolved by binding arbitration as set forth in TIM’s Terms of Use located here.
